Terms of Service

These Terms govern your access to and use of Techiea — the adaptive eLearning platform for English, Mathematics, Science, General Studies, History and Geography. Please read them carefully, together with our Privacy Policy.

Effective: 23 October 2026 Last updated: 23 October 2026

The short version

  • Techiea is for educational use only. Use it honestly, keep your account secure, and do not misuse other learners’ data.
  • If you are under 18, you need a parent, guardian, or authorised school representative to agree to these Terms. Learners under 13 need verifiable parental or school consent.
  • We own the platform, curriculum, and software. You keep ownership of the work you submit and grant us a limited licence to operate the service.
  • Adaptive scorecards and AI-assisted explanations are study aids — they are not professional, medical, legal, or official academic advice.
  • You can cancel a paid subscription at any time. Fees are refundable only as stated in §11 or where required by law.

1. Acceptance of these Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “your”, “User”) and Techiea (“Techiea”, “we”, “us”, “our”) governing your access to and use of the Techiea website, applications, learning content, assessments, scorecards, and related services (collectively, the “Platform”).

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

If you accept these Terms on behalf of a school, district, company, or other legal entity, you represent and warrant that you have the authority to bind that entity. In that case, “you” includes that entity.

2. Definitions

User Any person who accesses the Platform, including learners, parents, guardians, educators, and administrators.
Learner A User enrolled in learning content or assessments, from Kindergarten through College.

3. Eligibility and account registration

3.1 Age requirements

You must be at least 13 years old to create an account independently. If you are under 18, you may use the Platform only with the consent of a parent, legal guardian, or authorised school representative who agrees to these Terms on your behalf.

Learners under 13 may use Techiea only through a parent or guardian account, or through an Educational Institution that has obtained and documented verifiable parental consent in accordance with COPPA and applicable local law. We may request evidence of consent at any time.

3.2 Accurate information

You agree to provide accurate, current, and complete registration information, including your role (learner, parent, educator, administrator) and, where relevant, your Educational Institution. You must keep this information up to date.

3.3 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at security@techiea.com if you suspect unauthorised access. We are not liable for losses caused by your failure to safeguard your credentials.

3.4 One account per person

Accounts are personal. You may not share, sell, transfer, or sublicense your account or credentials, except that a parent or guardian may manage a child’s learner profile within a family account.

4. Schools and Educational Institutions

Where an Educational Institution creates or manages accounts, the institution is responsible for:

  • Obtaining and documenting all required parental or guardian consents, including under COPPA and FERPA where applicable.
  • Ensuring that student data is used only for legitimate educational purposes.
  • Maintaining the accuracy of enrolment and roster information.
  • Complying with its own acceptable-use, privacy, and safeguarding policies.

Techiea processes student data as described in our Privacy Policy and, where an institutional agreement applies, as a processor or service provider under that agreement. If there is a conflict between these Terms and a signed institutional agreement, the institutional agreement prevails for that institution’s users.

5. Educational use licence

Subject to your compliance with these Terms, Techiea grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal educational purposes, or for the internal educational purposes of your Educational Institution.

This licence does not permit you to:

  • Copy, reproduce, distribute, publicly display, or create derivative works of the Platform or its content, except as expressly allowed.
  • Reverse engineer, decompile, disassemble, or attempt to extract source code.
  • Use the Platform for commercial tutoring, resale, competitive analysis, or any commercial purpose without our prior written consent.
  • Frame, mirror, scrape, or systematically download content or data.
  • Circumvent licence limits, seat counts, paywalls, or access controls.

All rights not expressly granted are reserved by Techiea and its licensors.

6. Acceptable use

You agree to use the Platform lawfully, honestly, and respectfully. In particular, you agree to:

  • Use the Platform only for legitimate learning, teaching, and assessment purposes.
  • Complete tests and assessments honestly, without unauthorised assistance, impersonation, or automated answering tools.
  • Respect the privacy of other learners and educators, and not attempt to access data you are not authorised to view.
  • Respect intellectual property rights and the content licences that apply to materials on the Platform.
  • Follow any applicable school, district, or institutional technology-use policies.
  • Keep your contact and account information accurate.

You are responsible for your own conduct and for the conduct of anyone using your account.

7. Prohibited activities

You must not, and must not permit or assist anyone to:

  • Upload or transmit unlawful, harmful, threatening, harassing, defamatory, obscene, or discriminatory content.
  • Bully, harass, intimidate, impersonate, or misrepresent your identity or affiliation.
  • Enable or encourage academic misconduct, including cheating, plagiarism, or unauthorised collaboration.
  • Upload malware, viruses, or any code designed to disrupt or damage the Platform.
  • Attempt to gain unauthorised access to the Platform, other accounts, or Techiea systems.
  • Probe, scan, or test the vulnerability of the Platform without written authorisation.
  • Scrape, data-mine, harvest, or use automated means to collect data from the Platform.
  • Interfere with the availability, integrity, or performance of the Platform.
  • Use the Platform to send spam or unauthorised commercial communications.
  • Violate any applicable law, regulation, or third-party right.

Violation of this section may result in immediate suspension or termination, and may be reported to your Educational Institution or relevant authorities where appropriate.

8. Intellectual property

The Platform — including its software, design, curriculum, question banks, explanations, assessments, scorecards, graphics, logos, and trademarks — is owned by Techiea or its licensors and is protected by copyright, trademark, and other intellectual property laws.

“Techiea” and related marks, logos, and product names are trademarks of Techiea. You may not use them without our prior written consent, except for accurate, nominative references.

Nothing in these Terms transfers ownership of any Techiea intellectual property to you.

9. User content

9.1 You keep ownership

You retain ownership of the answers, responses, assignments, uploads, and messages you submit (“User Content”). Student work and learning records remain the property of the learner and, where applicable, their Educational Institution.

9.2 Licence to Techiea

By submitting User Content, you grant Techiea a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display, and use that content solely to provide, secure, and improve the Platform, and as otherwise described in our Privacy Policy. This licence ends when your content is deleted from the Platform, except for backups, legal retention, or aggregated/de-identified data.

9.3 Your responsibilities

You represent and warrant that you have all rights necessary to submit your User Content and to grant the licence above, and that your content does not infringe any third-party right or violate any law. You are responsible for your User Content.

10. Adaptive outputs, scorecards, and AI-assisted content

Techiea uses algorithms to estimate mastery, adjust question difficulty, recommend lessons, and generate scorecards and explanations. These Adaptive Outputs are study aids only. They may be incomplete, approximate, or contain errors, and they are not a substitute for professional teaching, official assessment, or institutional grading.

  • Adaptive difficulty and recommendations are estimates, not guarantees of performance or improvement.
  • AI-assisted explanations may contain inaccuracies; you should verify important information with a qualified educator or authoritative source.
  • Educators and institutions remain responsible for reviewing and validating any Adaptive Output they use in teaching or grading.
  • We do not use Adaptive Outputs to make decisions that produce legal or similarly significant effects about you.

You can request human review of an Adaptive Output where required by law by contacting support@techiea.com.

11. Payments, subscriptions, and refunds

11.1 Fees and billing

Certain features require a paid Subscription. Fees, billing periods, and plan details are shown at checkout or in your order form. By subscribing, you authorise us and our payment processors to charge the applicable fees, including taxes, on a recurring basis until cancelled.

11.2 Auto-renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. We will give reasonable advance notice of price changes, and price changes apply from your next billing period.

11.3 Cancellation

You may cancel at any time through your account settings or by contacting support. Cancellation stops future charges; access continues until the end of the current paid period unless otherwise stated.

11.4 Refunds

Except where required by applicable law, fees are non-refundable. We may, at our discretion, issue a refund or credit for duplicate charges, technical faults, or unused subscription periods. Statutory rights (including any mandatory consumer withdrawal rights) are not affected.

11.5 Institutional purchases

Where an Educational Institution purchases seats or a licence, invoicing, cancellation, and refund terms in the applicable order form or institutional agreement govern that purchase.

12. Service availability and changes

We work to keep Techiea available and reliable, but we do not guarantee uninterrupted or error-free access. The Platform may be unavailable due to scheduled maintenance, emergency security updates, third-party outages, or events beyond our reasonable control.

We may modify, update, or discontinue features from time to time. Where a change materially reduces paid functionality, we will provide reasonable notice and, where appropriate, a pro-rata remedy.

13. Disclaimers

To the maximum extent permitted by law, the Platform is provided “as is” and “as available”. Techiea disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Platform will meet your specific educational requirements, that Adaptive Outputs will be accurate or complete, or that use of the Platform will produce any particular academic result.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded, including statutory consumer guarantees.

14. Limitation of liability

To the maximum extent permitted by law, Techiea and its directors, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or educational opportunity, arising out of or relating to your use of the Platform.

To the maximum extent permitted by law, Techiea’s total aggregate liability arising out of or relating to these Terms or the Platform will not exceed the greater of (a) the amount you paid to Techiea for the Platform in the twelve months preceding the claim, or (b) one hundred US dollars (US$100).

These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or wilful misconduct.

15. Indemnification

You agree to indemnify, defend, and hold harmless Techiea and its officers, directors, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your User Content; (b) your violation of these Terms or applicable law; (c) your misuse of the Platform; or (d) any claim by a third party relating to your conduct. Techiea will promptly notify you of any such claim and may participate in its defence.

16. Suspension and termination

You may stop using the Platform and close your account at any time. Where an Educational Institution controls your account, closure may need to be coordinated with that institution.

We may suspend or terminate your access, with or without notice, if:

  • You materially breach these Terms, including the acceptable-use and prohibited-activities sections.
  • We are required to do so by law or by a competent authority.
  • Your use poses a security, legal, or safety risk to Techiea, other users, or the public.
  • Your account has been inactive for an extended period, subject to reasonable notice.

On termination, your licence to use the Platform ends. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

17. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except where mandatory local consumer-protection laws give you the protection of your country of residence. If you are a consumer in the EU/EEA or UK, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence.

18. Dispute resolution

18.1 Informal resolution first

Before filing a formal claim, you agree to contact us at legal@techiea.com and give us at least 30 days to try to resolve the dispute informally.

18.2 Binding arbitration

If we cannot resolve the dispute informally, and to the maximum extent permitted by law, the dispute will be resolved by final and binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. Arbitration will be conducted by a recognised arbitration provider under its consumer rules, seated in Delaware, in English.

18.3 Class-action waiver

To the maximum extent permitted by law, you and Techiea agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

18.4 Opt-out

You may opt out of the arbitration and class-action waiver provisions by sending written notice to legal@techiea.com within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

19. General provisions

  • Entire agreement. These Terms, together with the Privacy Policy and any applicable order form or institutional agreement, constitute the entire agreement between you and Techiea regarding the Platform.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
  • Notices. We may give notices via email, in-product messages, or posting on the Platform. Notices to Techiea must be sent to the addresses in §21.
  • Language. These Terms are drafted in English. Translations are for convenience; the English version prevails in case of conflict.

20. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new “last updated” date and, where changes are material, provide reasonable advance notice (for example, by email or in-product notification). Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform and may cancel any paid Subscription.
